Any user of this Clarius Group Limited ABN 43 002 724 334 (Clarius) site in general and where relevant anyone who registers with Clarius in any capacity through this site (Users) thereby agrees to the following terms and conditions.
1. Submission of Material to this Site by Users
Users agree to not use this site to in any way make available material that:
(a) breaches any applicable laws, regulations or codes of conduct; or
(b) encourages conduct that breaches any applicable laws, regulations or codes of conduct,
where the subject of such breaches may include but are not limited to:
(c) intellectual property rights infringement;
(d) dissemination of any form of unauthorised advertising or promotional material;
(e) dissemination of material containing harmful viruses that may affect software and hardware;
(f) dissemination of material that is discriminatory, harassing, abusive, libellous, defamatory, obscene or threatening or otherwise objectionable; or
(g) fraudulently misrepresenting yourself and/or providing false information;
and should such material be submitted to the site Users agree that Users accept all liability in relation to such material and also agree that Clarius may without prior notice remove such material from this site at any time and/or has the right to prevent the User from using the site.
2. Use of Material on this Site
In relation to any material to which access is gained through accessing this site (this Material), Users agree:
(a) not to copy, modify or distribute this Material for any purpose other than personal use without gaining the written consent of Clarius;
(b) to ensure that, regardless of whether or not the usage is personal as per 2(a), all copyright and proprietary notices in this Material are kept intact;
(c) that all trademarks, trade names, logos and information contained in this Material are the property of Clarius and its licensors (the Property);
(d) not to use the Property in any way without first gaining the written consent of Clarius; and
(e) to use any personal information contained in this Material in accordance with the Clarius Privacy Policy located on this site and linked to here.
3. Disclaimer
Clarius agrees that it will:
(a) use all reasonable efforts to have this site available to Users without fault or interruption;
(b) take reasonable care in compiling and presenting the information and material available on this site; and
(c) process personal data submitted to this site in accordance with the Clarius Privacy Policy;
however, Users agree that, to the extent permitted by law, Clarius will not be liable or responsible for:
(d) any costs, damages or losses incurred by Users in connection with their access to or use of this site;
(e) any reliance by Users on the content of this site in terms of its suitability, currency, accuracy or adequacy;
(f) any costs, damages or losses incurred by Users in connection with their access to or use of external sites to which this site provides links, including but not limited to the suitability, currency, accuracy or adequacy of the content on these external sites, the use of external links is at the Users own risk;
(g) any lack of availability to Users of this site due to factors outside of Clarius control or due to the periodic need for maintenance, repair and updating of this site by Clarius;
(h) any perceived guarantee, representation or warranty that Users rely on in relation to the availability of any engagement or appointment advertised on this site;
(i) any perceived guarantee, representation or warranty that Users rely on in relation to the suitability of Users to or contact by Clarius or any employers or clients;
(j) any investment or other financial decisions made on the basis of any Clarius company content on this site since such content is in summary form and in any case independent advice must always be sought by Users in such matters;
and any liability of Clarius that cannot lawfully be excluded is limited, at Clarius’ option to resupplying this site or any part of it to Users or limited to paying for the resupply or repair of this site or any part of it to Users.
4. Site Registration
Any Users that choose to register for a service offered on this site or register as a candidate for employment or any other engagement through Clarius or any of its subsidiary companies agree that Users:
(a) shall not mislead or deceive Clarius or any third parties who may rely on information provided by such Users that later turns out to be inaccurate or false information;
(b) shall be solely responsible for the suitability, currency, accuracy or adequacy of the information submitted by Users as part of and after registration;
(c) shall be solely responsible for the security and proper use of any passwords provided to Users as part of registration and accept full liability for any unauthorised or improper use of disclosure of any such password; and
(d) may have their registration account suspended or cancelled by Clarius with immediate effect if Users breach any of these Terms and Conditions.
5. Indemnity
Users agree to indemnify Clarius and keep Clarius fully indemnified against all losses, liabilities, costs, expenses, claims, or proceedings arising from use or misuse by Users of this site and for the avoidance of doubt Clarius will in no circumstances be responsible or liable for any loss or damage which may arise through Users use or access to this website whether direct, indirect, consequential, incidental, exemplary, punitive or special damages.

7. General
Clarius may at its sole discretion:

(c) amend these Site Terms and Conditions at any time;
The Laws of New South Wales will govern the use and accessing of this site, and the parties submit to the courts of that jurisdiction.
